ContrastHR Terms of Service

Welcome to ContrastHR. Contrast Software Ltd. and our partners (“ContrastHR,” “we,” “our,” or “us”) provide HR and wellness software designed to help companies manage employees, track HR processes, and promote workplace wellness.

By accessing or using ContrastHR services (“Services”), including HR features, fitness challenges, wellness tips, and related tools, you agree to these Terms of Service (“Terms”) and our [Privacy Policy]. If you do not agree, do not use the Services.

1. Accounts and Access
  • The company (“Customer”) owns all data entered into ContrastHR.
  • Customer administrators are responsible for setting up and managing access for their users.
  • Customers must ensure information provided is accurate and kept up to date.
  • Accounts are for authorized users only; passwords must be kept secure.

2. Use of Services
  • Services may only be used for lawful business purposes.
  • Customer is responsible for compliance with employment, HR, and workplace laws in their jurisdiction.
  • Services include optional wellness content and fitness challenges. Participation is voluntary.

3. Wellness and Fitness Disclaimer
  • Information provided in wellness programs, tips, and challenges is for educational purposes only and is not medical advice.
  • Employees should consult a qualified healthcare provider before beginning any new fitness or wellness program.
  • Participation in wellness activities is voluntary and at the user’s own risk. ContrastHR is not responsible for injuries, outcomes, or results related to wellness challenges or content.

4. Data and Privacy
  • Customer retains ownership of company and employee data.
  • ContrastHR processes data only to provide the Services.
  • Data handling follows our Privacy Policy, which is incorporated into these Terms.

5. Subscription, Fees, and Payment
  • Subscription fees are billed as agreed (monthly or annual).
  • Fees are non-refundable unless required by law.
  • Failure to pay may result in suspension or termination of access.
  • Invoices will be issued upon signup, with recurring billing per contract.

6. Intellectual Property
  • All software, content, branding, and technology remain the property of ContrastHR and its licensors.
  • Customers may not copy, resell, reverse engineer, or misuse the Services.

7. Support and Availability
  • ContrastHR strives for reliable uptime but does not guarantee uninterrupted service.
  • Support inquiries can be submitted via [email protected].

8. Termination
  • Customers may terminate at any time; termination is effective at the end of the subscription period.
  • ContrastHR may suspend or terminate accounts for misuse, unlawful activity, or non-payment.
  • Upon termination, Customers may export their data within 30 days.

9. Disclaimers
  • Services are provided “as is” and “as available.”
  • ContrastHR does not guarantee any specific results from HR tools, wellness programs, or recommendations.
  • We disclaim all warranties to the fullest extent permitted by law.

10. Limitation of Liability
  • ContrastHR is not liable for indirect, incidental, or consequential damages.
  • Our total liability is limited to the subscription fees paid in the 12 months before a claim.

11. Governing Law
  • These Terms are governed by the laws of Saskatchewan, Canada.
  • Any disputes will be handled in the courts of Saskatchewan, Canada.

12. Changes to Terms
  • ContrastHR may update these Terms from time to time.
  • Continued use of the Services means acceptance of the updated Terms.
